Citizens' privacy must become priority in digital age, says EU Commissioner Reding

(14 April 2009)In a video posted on her website this morning, Viviane Reding, the European Union's Commissioner for Information Society and Media, said that Europeans must have the right to control how their personal information is used, and said that the Commission would take action wherever EU Member States failed to ensure that new technologies such as behavioural advertising, RFID 'smart chips' or online social networking respected this right.

Telecoms: Commission calls on Italian regulator to comply with EU rules before changing access conditions to Telecom Italia's network

(14 April 2009)The European Commission today asked the Italian telecoms regulator (AGCOM) to notify it of the undertakings offered by Telecom Italia introducing significant changes in its internal organisation in order to ensure fair treatment of competitors. They have already been approved by AGCOM at national level. These undertakings implement an internal re-organisation of Telecom Italia and establish a special mechanism which aims to ensure non-discriminatory access for alternative operators to Telecom Italia's network. They therefore affect the ability of alternative operators to compete with Telecom Italia. Under the EU's common telecoms rules, AGCOM is obliged to consult the Commission and other national regulators on changes that, like this one, can impact the EU's single telecoms market before implemented. The notification is necessary to achieve transparency at EU level and legal certainty in the regulatory process.

Telecoms: Commission launches case against UK over privacy and personal data protection

(14 April 2009)The Commission has opened an infringement proceeding against the United Kingdom after a series of complaints by UK internet users, and extensive communication of the Commission with UK authorities, about the use of a behavioural advertising technology known as 'Phorm' by internet service providers. The proceeding addresses several problems with the UK's implementation of EU ePrivacy and personal data protection rules, under which EU countries must ensure, among other things, the confidentiality of communications by prohibiting interception and surveillance without the user's consent. These problems emerged during the Commission's inquiry into the UK authorities' action in response to complaints from internet users concerning Phorm.

Telecoms: Infringement case against Latvia on independence of regulator enters second phase

(14 April 2009)The European Commission has sent Latvia a reasoned opinion, the second phase of an infringement proceeding, for not following EU rules that guarantee the independence of national telecoms regulators. The Commission wants to make sure that Latvia respects the principle of separation between regulatory and ownership functions in the telecoms sector. Latvian authorities did not address the Commission's concerns in their response to the letter of formal notice of September last year (IP/08/1343) which is why the Commission now has launched the second phase of infringement proceedings.
